1. Eligibility

• You must be at least 18 years old.
• By using our Services, you confirm that you have the legal capacity to enter into a binding agreement.
• TYPEBEAT.FUN is not directed to children under 13. We do not knowingly collect information from children under 13.

2. Description of Services

TYPEBEAT.FUN provides the following services:

2.1 Beat Automation Tools

• Converts your beats into video format.
• Uploads them to your connected YouTube channel using the YouTube API.
• Manages metadata upon your instruction.

2.2 Marketplace Platform

• Provides a platform for producers to list beats for sale.
• TYPEBEAT.FUN is not a seller and does not participate in beat sales.
• Transactions are strictly between producer and customer.
• TYPEBEAT.FUN does not control, verify, or guarantee any beat, license, or seller claims.

2.3 YouTube Integration

• Tools that allow automated posting and management of your content through the YouTube API.
• We may modify, add, or remove features at any time to maintain legal compliance or service quality.

3. Marketplace: Independent Sellers & Platform Transparency

3.1 Independent Businesses

Producers are independent sellers, not employees or agents of TYPEBEAT.FUN.

3.2 TYPEBEAT.FUN Not a Party to Contracts

• We do not own, license, sell, or guarantee any beat.
• We do not provide or enforce beat licensing terms.
• All licensing agreements are solely between producer and customer.

3.3 No Ranking or Paid Promotion

Beats are sorted by artist only.

We do not:

• Rank beats algorithmically
• Offer paid placement or promotion
• Influence visibility of listings

3.4 Platform Responsibilities

TYPEBEAT.FUN is not responsible for:

• Accuracy of seller information
• Delivery of purchased beats
• License terms provided by producers
• Quality, legality, or originality of beats

3.5 Seller Requirements

Producers must:

• Provide accurate information
• Ensure they have rights to all content
• Provide clear licensing terms to buyers
• Handle consumer rights under EU/UK law if selling to EU/UK consumers

4. User Accounts

You are responsible for:

• Maintaining accurate account information
• Keeping your login credentials secure
• All activity under your account

You may not:

• Share, sell, or transfer your account
• Use automated tools to create accounts (unless using our official API)

5. Content Ownership & Licensing

5.1 Your Ownership

You retain all ownership rights to any beats, images, videos, audio, or other materials you upload.

5.2 License You Grant TYPEBEAT.FUN

You grant TYPEBEAT.FUN a limited, revocable, non-exclusive, worldwide, royalty-free license solely to:

• Host, store, and process your content
• Convert it into video format
• Upload it to your connected YouTube channel
• Display it on the marketplace
• Generate previews for user browsing

We do not:

• Use your content for advertising outside the platform without explicit consent
• Sell, license, or commercially exploit your content

This license ends when you delete the content from your account, except where retention is required for:

• Legal compliance
• Dispute resolution

5.3 Warranties for Content You Upload

You represent and warrant that:

• You have full rights to upload and use the content
• No third-party rights are infringed
• Any samples/loops are properly licensed
• The content is legal in all relevant jurisdictions

6. YouTube API Services

By using YouTube integration, you agree to the:

• YouTube Terms of Service
• Google Privacy Policy
• Google API Services User Data Policy (including Limited Use Requirements)

6.1 Authorization

You permit TYPEBEAT.FUN to:

• Upload videos to your YouTube channel
• Manage metadata (titles/descriptions/tags)
• View analytics of videos uploaded via our tool

6.2 Revocation

You may revoke access at any time here: https://security.google.com/settings/security/permissions

6.3 Google API Data Limited Use Requirements

TYPEBEAT.FUN:

• Does not transfer or sell YouTube API data
• Does not use or access data except to provide the service
• Does not use data for advertising
• Does not share data with third parties except subprocessors listed in the DPA
• Deletes YouTube data upon account deletion or revocation

7. Payments, Subscriptions & Refunds

7.1 Subscription Terms

• Subscriptions renew automatically.
• You will be clearly shown the price, billing period, and renewal terms before checkout.
• For CA residents: Renewal terms are displayed in a clear and conspicuous manner as required by California Automatic Renewal Law.

7.2 14-Day Withdrawal Right (EU/EEA/UK Only)

You have a statutory 14-day cooling‑off period.

If you start using the service immediately, you acknowledge you may lose this right once service is fully performed.

7.3 Refunds After Withdrawal Period

Refunds may be issued for:

• Technical errors preventing service use
• Duplicate charges
• Billing mistakes
• Service cancellation within 48 hours of purchase with minimal usage

7.4 Marketplace Payments

TYPEBEAT.FUN:

• Is not involved in payments between producers and buyers
• Does not handle refunds for marketplace purchases
• Does not offer payment protection or guarantees

7.5 Cancellation

• You can cancel at any time in account settings
• Access continues through the paid period

8. Data Protection

You have all rights under GDPR/UK GDPR/CCPA.

TYPEBEAT.FUN acts as:

• Controller for account and billing data
• Processor for uploaded content

8.1 Fraud Prevention & Security Monitoring

To protect our platform, users, marketplace, and YouTube API integrations from fraud, abuse, spam, and unauthorized access, TYPEBEAT.FUN collects and securely stores IP addresses and related technical metadata (such as browser/user-agent information) when you access or interact with our Services.

This data is used solely for:

• Fraud prevention
• Account security
• Detecting abusive or suspicious activity
• Legal compliance and safety investigations

We never sell IP addresses or use them for advertising or profiling.

Retention periods comply with GDPR/CCPA requirements and are outlined in our Privacy Policy.

9. EU Data Act Rights

You may request:

• Full export of your data
• Assistance in switching to another provider
• Deletion after export

TYPEBEAT.FUN will comply within statutory deadlines.

10. Prohibited Uses

You may not:

• Upload infringing, illegal, harmful, or misleading content
• Violate YouTube or Google API policies
• Scrape or crawl our platform
• Attempt to bypass security measures
• Impersonate others
• Use the platform for spamming

11. Content Removal & DMCA Compliance

We may remove content that violates these Terms or the law.

11.1 DMCA Takedown Requests

You may submit a valid counter-notice stating:

12. Account Termination

We may terminate accounts for:

• Violations of these Terms
• Legal requirements
• Inactivity over 24 months
• Fraud or abuse

EU/UK consumers receive 30 days' notice unless an urgent legal or safety reason applies.

13. Warranties & Service Levels

TYPEBEAT.FUN provides services with reasonable skill and care.

However, we do not guarantee:

• Uninterrupted service
• Error-free service
• Future availability of any feature

14. Limitation of Liability

To the fullest extent permitted by law:

For Business Users:

• TYPEBEAT.FUN is not liable for indirect, incidental, or consequential damages
• Maximum liability is the greater of $100 or the amount paid in the last 12 months

For EU/UK Consumers:

We do not limit liability for:

• Death/personal injury due to negligence
• Fraud
• Gross negligence

Other losses are limited as allowed by consumer law.

15. Indemnification

Business users agree to indemnify TYPEBEAT.FUN for claims arising from:

• Content uploaded
• Use of the Services
• Violations of these Terms

Not applicable to consumers to the extent restricted by law.

16. Dispute Resolution

US Business Users:

• Binding arbitration in Colorado
• 30‑day arbitration opt‑out available (email us)

EU/UK Consumers:

• May bring claims in courts of your residence
• May use local ADR/ODR mechanisms

17. General Terms

• These Terms are the entire agreement
• If any clause is invalid, others remain effective
• No waiver of rights unless in writing
• We may assign our rights during mergers/acquisitions

18. Changes to Terms

• We will notify you at least 30 days before material changes
• EU/UK consumers may terminate if they do not accept the changes

21. Google API Data Disclosure

TYPEBEAT.FUN:

• Uses YouTube API data only to operate user-requested features.
• Does not sell, transfer, or share YouTube data.
• Stores OAuth tokens securely and deletes them promptly upon revocation or account deletion.
• Provides users with the right to delete YouTube-related data at any time.
• Complies with Google API Services User Data Policy, including Limited Use Requirements.

Additional Disclosures

By connecting your YouTube account, you acknowledge and agree that:

• TYPEBEAT.FUN will only access data strictly necessary to perform uploads, conversions, and metadata management.
• TYPEBEAT.FUN will not use YouTube data for advertising, marketing, or any unrelated activity.
• You may revoke API permissions at https://security.google.com/settings/security/permissions.

22. DMCA Policy

We comply with the Digital Millennium Copyright Act.

22.1 Submitting a DMCA Takedown Notice

• A statement under penalty of perjury that removal was mistaken.
• Consent to jurisdiction of U.S. Federal Court in Colorado.

22.3 Repeat Infringer Policy

Repeated infringement may result in account termination.

23. Marketplace Seller Agreement

23.1 Relationship

Producers are independent sellers. TYPEBEAT.FUN is not a party to transactions.

We do not:

• Verify seller claims.
• Guarantee beat quality or licensing accuracy.
• Provide payment protection.

23.2 Listing Requirements

Sellers must:

• Provide accurate information.
• Upload only content they fully own or are licensed to use.
• Provide clear licensing terms to customers.
• Comply with consumer law in their jurisdictions.

23.3 Visibility

Beats are sorted strictly by artist. No ranking or paid promotion.

23.4 Marketplace Removal & Suspension

We may take action for illegal content, fraud, or violations.

EU sellers receive 15 days' notice unless immediate action is required.

24. Refund Policy

24.1 Subscription Refunds

Refunds are available for:

• Duplicate charges.
• Billing errors.
• Technical issues preventing service delivery.
• Cancellation within 48 hours of initial purchase with minimal usage.

24.2 EU/EEA/UK Withdrawal Rights

You have 14 days to withdraw.

Using automation tools before the period ends may void this right.

24.3 Marketplace Refunds

Marketplace refunds are handled exclusively by producers. TYPEBEAT.FUN does not mediate or process refunds for beat purchases.

25. Security & Vulnerability Disclosure

TYPEBEAT.FUN uses commercially reasonable efforts to maintain security.

We also log and store IP addresses and other technical security data to detect fraud, prevent abuse, and protect user accounts and platform integrity.

We may suspend accounts engaging in suspicious or abusive activity.
